You Got a DUI.  Now what?

SO YOU GOT CAUGHT, NOW WHAT?

In the Commonwealth of Kentucky, DUI Offenders will have their license suspended either at the initial arraignment or once convicted.  Usually a first offender without any aggravating circumstances involved in the arrest will have their license suspended after they are convicted.  This typically not the case for DUI second or subsequent offender; they will likely have their license suspended at arraignment. 

The first step to getting started in a program, which will be required for license re-instatement is to schedule an assessment with a LICENSED DUI PROVIDER.

WHAT HAPPENS IN THE ASSESSMENT?

During the assessment interview, the assessor will develop a comprehensive offender social history.  In addition, the offender will complete the AUDIT and DAST screening inventories.  These instruments and the social history will be used by the assessor during the client interview to determine the appropriate intervention options.  Intervention options are; education, outpatient treatment, intensive outpatient treatment, residential treatment and/or detox.  Any combination of interventions may be required depending upon the severity of the substance use/abuse problem. 

DRIVING UNIMPAIRED 20-HOUR EDUCATION PROGRAM

The only authorized education curriculum approved for use in Kentucky is: “PRI DRIVING UNIMPAIRED 20 HOUR” program.  The education program is limited to first offenders or multiple offenders who need education prior to entering a treatment service.

Kentucky Administrative Regulations (KAR) allow for the program to be delivered in three or fewer sessions per week and no more than three hours per session.  Any deviations from these delivery guidelines are a violation of KAR requirements and may not be approved by DOT for license re-instatement. 

OUTPATIENT TREATMENT PROGRAM

KAR establishes specific guidelines for all levels of care.  Outpatient treatment delivery standards require that the treatment group be provided one time per week in ninety minute sessions.  Most outpatient treatment programs offer an open enter/exit group format, which allows for new members to join the group at any time
